1. Who you are dealing with
8Deploy is a managed hosting service operated by WeActive8. When these terms say "we" or "us", they mean WeActive8. When they say "you", they mean the person or company that holds the account.
2. What we provide
We host your websites, applications, databases and email on infrastructure we own and operate, and we give you a control panel to manage them. What is included depends on the plan you are on, and the plans are set out on our pricing page.
We look after the platform: the servers, the operating system, the web server, the certificates, the backups and the network. You look after what you put on it: your site, your code, your content and your users.
3. Your account
You are responsible for keeping your login secure and for anything done through your account. If you invite other people onto your account, you are responsible for what they do too, and you control what they are allowed to touch.
Tell us promptly if you think someone has gained access to your account who should not have.
4. Acceptable use
There are things you may not do with our hosting. They are listed in our Acceptable Use Policy, which forms part of these terms. In short: nothing illegal, nothing that harms other people, and nothing that damages the platform for other customers.
5. Paying for it
Renewal
Plans renew automatically at the end of each billing period, at the price then in effect for your plan. We will tell you before your price changes, and any change takes effect at your next renewal, never in the middle of a period you have already paid for.
If a payment fails
We will contact you, more than once, and we will tell you exactly when your sites will be taken offline if the balance is not settled. Nothing is switched off without warning. If the account is suspended, your data is retained and recoverable under our Data Retention Policy.
Refunds
If you cancel, your plan runs to the end of the period you have paid for and then stops. We do not automatically refund unused time, but if you believe you have been charged in error, write to us and we will look at it honestly.
6. Suspension and termination
We may suspend or close an account that is not paid for, that breaches the Acceptable Use Policy, or that is being used in a way that endangers our platform or our other customers.
Where we can give notice first, we will. Where the situation is urgent, such as an active attack or illegal content, we may act immediately and tell you straight afterwards.
You may close your account at any time, from your panel or by writing to us.
7. Your data and your backups
Your content remains yours. We do not claim ownership of it, we do not sell it, and we do not use it for anything except running the service you are paying for.
We take automatic backups, and you can download a complete copy of everything at any time without asking us. Backups are a safety net, not a substitute for your own copy. How long we keep your data, and what happens to it if your account closes, is set out in full in our Data Retention Policy.
8. Availability
We aim to keep your sites online continuously, and our commitments and their limits are described in our Service Level page. We run our own hardware, and we would rather tell you exactly what that means than make a promise we cannot keep.
9. What we are not responsible for
We are responsible for running the platform properly. We are not responsible for:
- The content, code or configuration you or your team put on it.
- Third-party software you install, including plugins and themes, and anything they break or expose.
- Loss of data you were able to download and did not, once the retention period in our Data Retention Policy has passed.
- Loss caused by events outside our reasonable control.
To the extent the law allows it, our total liability to you for any claim is limited to the amount you paid us for the service in the twelve months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited.
10. Changes to these terms
We may update these terms. If a change materially affects you, we will tell you before it takes effect, and we will not apply it retroactively to a period you have already paid for.
